PrimeSite™ offers a number of Internet-related services.

It is contrary to our policy for any accountholder - through an PrimeSite™-provided account - to engage in any activities using the service of another provider, but channeling such activities through an PrimeSite™ account or with a PrimeSite™ account as a front end for responses (such as unsolicited email or marketing campaigns). PrimeSite™ considers these practices to constitute abuse of its service and of the recipients of such unsolicited mailings and/or postings, who often bear the expense. Therefore, these practices are prohibited by PrimeSite™'s terms and conditions of service. Engaging in any of these practices will result in termination of the offender's account and/or access to PrimeSite™ services.

In addition, PrimeSite™ reserves the right, where feasible, to implement technical mechanisms which block such activities.

This policy addresses only the kinds of network abuse specifically enumerated above. In addition to these activities, PrimeSite™'s terms and conditions of service also prohibit other forms of abuse such as harassment and the posting of illegal or unlawful materials, and PrimeSite™ will respond as appropriate to these other activities as well.

Nothing contained in this policy shall be construed to limit PrimeSite™'s actions or remedies in any way with respect to any of the foregoing activities, and PrimeSite™ reserves the right to take any and all additional actions it may deem appropriate with respect to such activities, including without limitation taking action to recover the costs and expenses of identifying offenders and removing them from use of PrimeSite™ services.

In addition, PrimeSite™ reserves at all times all rights and remedies available to it with respect to such activities at law or in equity.

By use of the Site, you agree to use the Site in a manner consistent with all applicable laws and regulations and in accordance with the terms and conditions discussed below.

Site Guidelines:

PrimeSite™ is not responsible for the content of any website account, and the views expressed are solely the responsibility of the accountholder.

Indemnity:

User agrees to indemnify PrimeSite™ and any third-party information providers against any and all claims and expenses, including attorneys' fees, arising from the User's use of the Site. This expressly includes: (i) User's responsibility for any and all liability arising from the violation or infringement of proprietary rights or copyrights and (ii) any libelous or unlawful material contained within User's Web Page or other portion of the Site.

Web Presence and Uptime (Hosting):

Responsibility for our web hosting (i.e. integrity of the service at any given time) is susceptible to certain system conditions. As a general rule, all web servers - like any computing device - will need to be restarted. All servers and their components are prone to failure and component replacement. System outtages - those within the world-wide network of devices and connections beyond the scope of PrimeSite™ accounts and beyond our control can also affect connectability. These factors must be taken into consideration when offering or accepting a web hosting account with any web hosting service.

Should a system-wide outtage require more time than the typical 5 minutes to restart, or 30 minutes to replace a component time, PrimeSite™ will attempt to inform by way of email or post within our website the status of any resolution.

Termination of Service:

PrimeSite™ may terminate any and all information, communications, Postings, or Web Pages at any time, without notice, for conduct that violates this Agreement or other policies or guidelines set out by PrimeSite™ elsewhere on the Site. PrimeSite™ may terminate and delete any and all information, communications, Postings, or Web Pages for online conduct that PrimeSite™ believes is harmful to other Users, the business of PrimeSite™, or other third-party information providers.

PrimeSite™ subscribers may cancel their service at any time without further obligation. The customer can cancel service at any time after payment and setup (without further obligation), but the first year of service is non-refundable.

PrimeSite™ Administration reserves the right to cancel or disable any account based on the terms of service provided here, and customers accept the terms of service as provided prior to account setup.

End User License Agreement

By downloading or using this software of Echoes Media Inc. or its subsidiaries ("PrimeSite™"), you agree to the following terms and conditions. If you do not agree with such terms and conditions, do not use the software.

The export and re-export of Echoes Media Inc. software products are controlled by the United States Export Administration Regulations and such software may not be exported or re-exported to Cuba, Iran, Iraq, Libya, North Korea, Sudan, or Syria or any country to which the United States embargoes goods. In addition, Echoes Media Inc. software may not be distributed to persons on the Table of Denial Orders, the Entity List, or the List of Specially Designated Nationals.

By downloading or using this software product you are certifying that you are not a national of Cuba, Iran, Iraq, Libya, North Korea, Sudan, or Syria or any country to which the United States embargoes goods and that you are not a person on the Table of Denial Orders, the Entity List, or the List of Specially Designated Nationals.

DISCLAIMER OF WARRANTIES: YOU AGREE THAT ECHOES MEDIA HAS MADE NO EXPRESS WARRANTIES TO YOU REGARDING THE SOFTWARE AND THAT THE SOFTWARE IS BEING PROVIDED TO YOU "AS IS" WITHOUT WARRANTY OF ANY KIND. ECHOES MEDIA DISCLAIMS ALL WARRANTIES WITH REGARD TO THE SOFTWARE, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, MERCHANTABLE QUALITY OR NONINFRINGEMENT OF THIRD PARTY RIGHTS. Some states or jurisdictions do not allow the exclusion of implied warranties so the above limitations may not apply to you.

LIMIT OF LIABILITY: IN NO EVENT WILL ECHOES MEDIA BE LIABLE TO YOU FOR ANY LOSS OF USE, INTERRUPTION OF BUSINESS, OR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING LOST PROFITS) REGARDLESS OF THE FORM OF ACTION WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT PRODUCT LIABILITY OR OTHERWISE, EVEN IF ECHOES MEDIA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Some states or jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
